# The Clause 5 Loop > The Constitution read word by word against the tax on inflation: the loop is real, the fix is a Bill, and every premise is graded. A study by Gavin Robert McGowen (https://interstellarblends.com). A study of the texts, not legal advice. The question: does taxing the nominal gain that the government's own inflation produces violate the Constitution, and does the loop force a binary: enforce the words, or permit double extraction? The answer left standing: A nominal gain is taxable as income counted in the dollar Congress defines, the Origination Clause keeps its full effect, inflation is neither a Tax nor a Bill, and the remedy is a Bill to index basis. How it reads: By strict syntactic textualism: the official words, their grammar and their meaning at ratification, with every premise named and graded and every inference checked by the Z3 solver. How it grades: Every step of the study carries one of nine grades, from the firmest to the weakest. - stated: The source says it in its own words, and the study quotes them. - it follows: Logic alone gets there from what is stated, and a computer solver checks the step. - strong support: The evidence for it far outweighs the evidence against it. - moderate support: More of the evidence points for it than against it, but real evidence points the other way. - one reading: The words allow it but do not require it; another reading fits them as well. - left open: The evidence does not settle it either way. - weak support: Some evidence points for it, but more points against it. - not shown: It is claimed, but the record does not establish it. - ruled out: The words or the logic exclude it. A chain is only as good as its weakest link: a conclusion never gets a better grade than the weakest step it needs. What it does not claim: It is a study of the texts, not tax or legal advice: a tax professional can tell you what the law asks of your own sale. It does not find that the Constitution forbids the tax on a nominal gain: the constitutional claim fails at two points the words decide (the clause’s subject, and the canon’s definition), and at one that the evidence of 1913 decides (the measure of income). The fix it leaves standing is a Bill. It does not say the Court has ruled on the loop: the Supreme Court has never decided the loop as a whole, but it has decided each of its parts. And it does not lay every rise in prices on the Federal Reserve: the loop holds at moderate support, and its weakest step is cause, since in any one year other forces share the rise in prices. ## Pages - [The texts](https://clause5loop.com/texts/index.md): Three texts set the case, quoted whole and never edited. - [The method](https://clause5loop.com/method/index.md): The words first, every premise named and graded, every link checked by a solver. - [The words](https://clause5loop.com/words/index.md): Two clauses, read by their syntax, decide the case. - [The argument](https://clause5loop.com/argument/index.md): Each argument at its strongest, before a single grade. - [Text 01, premise by premise](https://clause5loop.com/premises-text-01/index.md): Thirty-three premises graded: the loop holds, and the law counts income in dollars. - [Text 02, premise by premise](https://clause5loop.com/premises-text-02/index.md): Twenty-seven premises graded: the transfer is real, and the clause governs Bills. - [The Court, the rules, the rivals](https://clause5loop.com/court-rules-readings/index.md): The Court’s record, Gavin’s two rules, and the rival readings that carry the case. - [1787 and 1913](https://clause5loop.com/meaning/index.md): 1787 distrusted paper money; 1913 counted income in a gold dollar that still lost half its buying power. - [The facts](https://clause5loop.com/facts/index.md): Text 02’s seven figures hold, every one. - [The loop](https://clause5loop.com/loop/index.md): The loop is real, all the way around. - [What the loop costs](https://clause5loop.com/costs/index.md): In every year measured, a large share of the tax on gains fell on inflation. - [The links of text 01](https://clause5loop.com/links-text-01/index.md): Every link valid, each one checked by a solver. - [The links of text 02](https://clause5loop.com/links-text-02/index.md): The transfer holds, and the clause reaches every Bill for raising Revenue. - [The binary tested](https://clause5loop.com/binary/index.md): One answer from the words: a dollar gain is income, and the Origination Clause keeps its full effect. - [What courts have held](https://clause5loop.com/courts/index.md): Forty-five Supreme Court cases, every one opened: the Court has never ruled on the loop as a whole. - [Thirteen hard questions](https://clause5loop.com/questions/index.md): The hardest questions put to the argument, each answered from the record. - [The proof](https://clause5loop.com/proof/index.md): Eighty-eight checks by a solver, each with the result expected. - [If a link fails](https://clause5loop.com/if-a-link-fails/index.md): Test any premise and see exactly what rests on it. - [The outcome left standing](https://clause5loop.com/outcome/index.md): A dollar gain is income, the clause keeps its effect, and the fix is a Bill. - [Sources](https://clause5loop.com/sources/index.md): 178 pages opened; every quotation matched to its page. ## The questions this study answers - [Can the tax on inflation be stopped?](https://clause5loop.com/): Yes, by a Bill to index basis, starting in the House. Congress named the effect in 1981 and cured it only in the brackets, and the Treasury “does not have legal authority” to index basis by regulation. In 1913 income was “The return in money”, so the cure is Congress’s (K-A3, strong support), and the Supreme Court has never ruled on the loop as a whole. - [What does the Clause 5 argument claim?](https://clause5loop.com/texts/): That the government regulates the dollar under Clause 5, taxes as gain the nominal increase that regulation produces, and that the Court must either enforce the words or declare that the Constitution permits double extraction. - [How does the study read the Constitution?](https://clause5loop.com/method/): By strict syntactic textualism: the official words, their grammar and their meaning at ratification, with every premise named and graded and every inference checked by the Z3 solver. - [Does the Origination Clause govern revenue or Bills?](https://clause5loop.com/words/): Bills. Its subject is “All Bills for raising Revenue”, and revenue appears only inside the phrase that says which Bills. - [What is the strongest case for the Clause 5 loop?](https://clause5loop.com/argument/): The government aims at the rise in prices, and the Code taxes the gain that rise produces; Congress named the result the “INFLATION-CAUSED TAX INCREASE” and cured it only in the brackets. - [Did “income” in 1913 mean a gain in purchasing power?](https://clause5loop.com/premises-text-01/): No source of 1909 to 1913 in the record counts it so. Black’s (1910) defines income as “The return in money from one’s business, labor or capital invested; gains, profit or private revenue”. - [Is inflation taxation without representation?](https://clause5loop.com/premises-text-02/): Not in the Constitution’s sense: the Origination Clause governs Bills for raising Revenue, and inflation is not a Bill. The transfer inflation brings about is real, with moderate support. - [Has the Supreme Court ruled that the executive may dilute the dollar?](https://clause5loop.com/court-rules-readings/): No. None of the 45 Supreme Court cases in the record holds that the Executive may dilute the dollar by increasing the money supply. - [What did “income” mean when the Sixteenth Amendment was ratified?](https://clause5loop.com/meaning/): A gain counted in money: “The return in money from one’s business, labor or capital invested; gains, profit or private revenue” (Black’s, 1910). - [Did money growth cause the 3.8 percent inflation of 2026?](https://clause5loop.com/facts/): The figures do not show it. In the twelve months to April 2026 M2 grew 4.7 percent, but energy rose 17.9 percent and carried about 1.27 of the 3.8 points. - [Does the government tax gains its own inflation creates?](https://clause5loop.com/loop/): Yes, with moderate support: the Federal Reserve aims at 2 percent inflation, and § 1001 taxes the dollar gain counted from cost, with no adjustment for inflation. - [How much of the tax on gains is a tax on inflation?](https://clause5loop.com/costs/): In the years measured, a large share: a quarter of capital-gains revenue in fiscal 2017, $34 billion of $134 billion; a third in 2012; about half of the gains in 1993; and in 1973, gains on corporate stock that were real losses. For fiscal 2026 to 2035, CRS puts the cost of indexing the basis of assets already held at $955 billion. - [Is the Clause 5 argument logically valid?](https://clause5loop.com/links-text-01/): Each link is valid, but valid is not sound: its conclusions rest on premises with weak support (AU4) or ruled out (AU9, AU10). - [Does inflation bypass the House’s power over taxes?](https://clause5loop.com/links-text-02/): Only with weak support: the words grant borrowing beside taxes and give Congress the money powers, and the money statutes passed the House. - [Is there a third construction between enforcing the words and permitting double extraction?](https://clause5loop.com/binary/): Yes. A gain counted in the dollar Congress defines is income, inflation is neither a Tax nor a Bill, and the Origination Clause keeps its full effect; the solver finds it consistent with the words. - [What has the Supreme Court decided about money, taxes and gains?](https://clause5loop.com/courts/): That Congress may make paper money a legal tender, that contracts cannot fetter its power over the currency, that revenue bills levy taxes in the strict sense, and that a gain is taxed on the dollar difference. - [Can capital gains be indexed for inflation?](https://clause5loop.com/questions/): By Congress, yes: how to measure gain is Congress’s choice. The Justice Department concluded in 1992 that the Treasury “does not have legal authority to index capital gains for inflation by means of regulation”. - [How was the logic checked?](https://clause5loop.com/proof/): With the Z3 solver: every conclusion follows from its premises and fails when any one is dropped, and every rival construction is tested for consistency with the words. All 88 checks give the expected result. - [What does the binary depend on?](https://clause5loop.com/if-a-link-fails/): On AU4 (an accession to wealth measured in real terms) with A4, AU5 and AU7, or on AU12 (inflation itself an extraction); each route rests on a premise with weak support. - [What is the outcome left standing?](https://clause5loop.com/outcome/): A nominal gain is taxable as income counted in the dollar Congress defines, the Origination Clause keeps its full effect, inflation is neither a Tax nor a Bill, and the remedy is a Bill to index basis. - [Where does the study get its words?](https://clause5loop.com/sources/): From 178 pages opened at their sources: the Constitution, the Code, the Statutes at Large, the Supreme Court’s opinions, the dictionaries of 1828 to 1913, the federal data releases, and the economists in their own words. ## The atlas - [The atlas](https://clause5loop.com/atlas/): every premise, link and outcome, graded, with what each rests on; the argument followed as eleven stops. ## The whole study as one text - [llms-full.txt](https://clause5loop.com/llms-full.txt)
